Terms and conditions of use of GRACES.community

GRACES community is the first community of Compliance & Ethics - Internal Control & Audit - Risk Management experts, comprising a recruitment platform with a matching system; a media platform containing articles, news, interviews and regulatory intelligence; a calendar of regulatory events and a unique remuneration comparator for these professions.

GRACES community is a recruitment consultancy specializing in the various community professions (list of professions available here in the "all our expertise" section).

In order to meet the demands of recruiters and the expectations of candidates, GRACES community has decided to provide its members with fast, high value-added solutions: job offers, candidate search, direct approach, knowledge of the recruitment market for the community's professions, including remuneration, regulatory information, assessment of candidate potential, skills files, HR consulting for companies and candidates, training and coaching.

It is in this context that GRACES community has set up a complete range of services, via the Site, for Recruiters (the "Recruiter") and Candidates (the "Candidate") working in the community's professions in all sectors of activity.

ARTICLE 1. PURPOSE

Access to the Site and use of its content are subject to the General Conditions of Use described below (the "GCU"). Any person may access the Site (the "Visitor"). By accessing and browsing the Site, the Visitor constitutes unreserved acceptance of the Site's GCU.

ARTICLE 2. REGISTRATION AND ACCESS TO THE SITE

Access to the site is free to all Visitors. Any visitor may submit a publication or an event. Each proposed contribution is reviewed and validated by an administrator, who may decide to publish it or not, without justification.

Access to the recruitment platform implies the creation of a "Recruiter" or "Candidate" account, which requires the completion of several mandatory fields in order to complete the profile. Failure to comply with these GTU may result in the removal of access to the recruitment platform.

ARTICLE 3. INTELLECTUAL PROPERTY

The Site is the exclusive property of GRACES community, which alone is entitled to use and exploit the intellectual property rights attached to the Site, in particular trademarks, copyrights and image rights, either originally or by virtue of express authorization, and all other intellectual property rights.

The use of all or part of the Site, in particular by downloading, reproduction, transmission or representation for purposes other than personal and private use for non-commercial purposes, is strictly prohibited.

ARTICLE 4. SITE CONTENT

GRACES community makes every effort to ensure that the information published on the Site is accurate and up-to-date, and reserves the right to correct the content at any time without notice.

ARTICLE 5. LIABILITY

5.1. Responsibility of GRACES community

Where permitted by law, GRACES community accepts no liability:

• for any imprecision, inaccuracy, omission or for any damage resulting from the intrusion of a third party leading to a modification of the information made available on the Site.
• in the event of damage caused by an unauthorized third party accessing the Site or making it impossible to access.
• in the event of loss of income or sales,
• in the event of business interruption,
• in the event of loss of profits or contracts,
• in the event of loss of anticipated savings,
• in the event of data loss,
• in the event of loss of working or management time,
• in the event of image damage,
• in the event of loss of opportunity, in particular to order a Product,
• in the event of moral prejudice.
• in the event of any other financial loss,
• in the event of any declaration or sanction of non-compliance with any national, European or international legal obligation, ...

The documents, descriptions and information relating to the Products appearing on theSite are not covered by any warranty, express or implied, with the exception of the warranties provided by law.

GRACES community makes no warranty with respect to any harm that may be caused by the transmission of a computer virus, worm, time bomb, Trojan horse, cancelbot, logic bomb or any other form of programming routine designed to damage, destroy or otherwise impair the functionality of a computer or interfere with the proper working of a computer, including any transmission resulting from a download of any content by the Customer and/or the User, the software used by the Customer and/or the User to download content from the Site, or the server providing access to the Site. In this respect, the Customer and/or User acknowledges that it is his/her responsibility to install appropriate anti-virus and security software on his/her computer hardware and any other devices in order to protect them against any bugs, viruses or other such programming routines that may prove harmful.

TheCustomer and/or User acknowledges that he/she assumes all risks associated with any content downloaded or otherwise obtained through the use of the Site and acknowledges that he/she is solely responsible for any damage to his/her computer system and/or loss of data resulting from the download of such content.

5.2. Visitor's responsibility

The Visitor undertakes to use and access theSite in accordance with these GCU, not to hinder the proper operation of theSite in any way whatsoever, not to infringe the rights ofGRACES community or third parties in any way whatsoever, not to infringe the law and regulations in force.

In particular, the Visitor undertakes, when using and accessing the Site, not to :

• violate the intellectual property rights of GRACES community ;
• bypass technical protection systems, carry out or incite acts of piracy, transmit viruses, interrupt, destroy or limit the functionality of theSite or any GRACES community tool, software or hardware;
• damage the image of GRACES community ;
• Respect the laws and regulations in force, public order and morality by using the contact addresses ofGRACES community,
• Not to hinder or disrupt the operation of the Site and its associated servers and networks, in particular by jeopardizing their operation, security or integrity,
• Not to use viruses, inject computer bugs or exploit any other form of vulnerability to obtain advantages or access to protected data on the Site,
• Immediately notify GRACES community if it discovers a security vulnerability in the Site,
• Not to collect, store or distribute to any third party the contents of the Site,
• Not to post, record or transmit copyrighted material, unless he/she guarantees that he/she has obtained permission from the copyright holder and can provide proof of such permission,
• Not to collect, store or disseminate the personal data of third parties, whether or not they are Customers and/or Site Users,
• Do not harass, denigrate or insult members of the GRACES community,
• Not to attempt to mislead other Customers and/or Users by usurping the name, pseudonym or corporate name of another natural or legal person,
• Not to disparage GRACES community, its publications, Products and/or Services
• Do not apply for a job seen on GRACES community elsewhere than on GRACES community

Furthermore, if applicable, the Visitor is solely responsible for the use of his GRACES community account and the actions carried out through his account.

ARTICLE 6. SITE AVAILABILITY

The Visitor is informed that access to the Site may be interrupted at any time by GRACES community for reasons of maintenance, security or any other technical constraint.

ARTICLE 7. PROTECTION OF PERSONAL DATA

GRACES community informs the Site Visitor that the personal data collected is processed in accordance with the Privacy Policy available here: https: //graces.community/cookies

ARTICLE 8. MODIFICATIONS

GRACES community informs the Site Visitor that these GCU may be modified at any time. These modifications come into force as soon as they are posted online and are deemed to have been accepted without reservation by any Visitor accessing the Site after they have been posted online. It is therefore the responsibility of all Visitors to read these GTUs carefully before browsing the Site.

ARTICLE 9. APPLICABLE LAW AND COMPETENT JURISDICTION

The present conditions are governed by French law.

Any dispute arising from the use of this site shall be subject to the jurisdiction of the French courts.

All disputes arising from the application of these General Terms and Conditions of Use shall be submitted to the exclusive jurisdiction of the Paris Commercial Court.
